Effective Date: The date of your purchase of the DIEM: The Art of Every Day Bundle ("the bundle").
This agreement (the "Terms") governs your purchase and use of the DIEM: The Art of Every Day Bundle offered by Dr. James Rouse/Be Alive & Well, LLC (the "Company"). By purchasing the bundle, you agree to these Terms, which form a legally binding agreement between you and the Company.
Bundle Overview: The DIEM: The Art of Every Day Bundle is designed to provide a transformative experience through its combined offerings, which include:
1. DIEM: The Practices of Every Day Course: A structured online program featuring curated lessons, actionable strategies, and downloadable resources designed to foster personal growth and transformation.
2. DIEM Inner Circle Membership: A one-year subscription providing access to live group coaching sessions, exclusive content, and a supportive community grounded in mindful daily practices.
3. DIEM: The Art of Every Day eBook: A downloadable, non-transferable digital book offering insights and practical strategies for living a mindful, purpose-driven life.
These components work together to provide tools, resources, and community support to help you live each day with greater intention, resilience, and purpose. Participants must be at least 18 years of age to purchase the bundle. By completing your purchase, you affirm that you meet this requirement and are legally capable of entering into this agreement.
Payment Terms: The bundle is available as a one-time purchase, which includes all listed components. Payment in full is required at the time of purchase. By providing your payment information, you authorize the Company to charge your selected payment method for the full amount. All payments are final and non-refundable except as outlined in the "Refund Policy" and "Hardship Exceptions" sections.
Refund Policy: Due to the nature of the products and the immediate access provided to digital materials, all sales are final. No refunds will be issued under any circumstances, including but not limited to dissatisfaction with the content, failure to access or complete the Course, or technical issues not directly related to the Company’s platforms. In cases of significant hardship, as outlined in the "Hardship Exceptions" section, you may request a review of your eligibility for partial relief.
These requests will be evaluated on a case-by-case basis at the sole discretion of the Company. If you experience technical difficulties accessing any of the components, you are responsible for contacting the Company at [email protected] for assistance.
Hardship Exceptions: If you experience significant hardship, such as a documented medical emergency or an unforeseen life event, you may submit a written request for review to [email protected]. Requests must include supporting documentation and will be evaluated on a case-by-case basis at the Company’s sole discretion. The Company reserves the right to determine the outcome of such requests in accordance with applicable laws.
Access and Use of Materials: By purchasing the bundle, you are granted a personal, non-transferable, revocable license to access and use the Course, Membership, and eBook materials. Sharing login credentials, course materials, or the eBook with anyone who has not officially purchased the bundle is strictly prohibited. This ensures fairness to all participants and protects the integrity of the resources. Any unauthorized sharing, reproduction, or distribution of materials will result in the immediate revocation of access without a refund.
DIEM Inner Circle Membership Terms: The DIEM Inner Circle Membership included in the bundle is valid for one year from the date of purchase. Membership benefits include access to live group coaching sessions, exclusive content, and a supportive community. After one year, participants may choose to renew their Membership directly through the Company. Access to Membership benefits is contingent upon an active Membership.
eBook Usage Terms: The eBook for DIEM: The Art of Every Day is a digital product provided as part of the bundle. It is licensed for personal, non-commercial use only. You may not share, reproduce, distribute, or create derivative works based on the eBook without express written consent from the Company.
Coaching Disclaimer: The Course, Membership, and eBook are intended to provide general guidance, tools, and strategies for mindful, purpose-driven living. These offerings are not substitutes for professional medical, psychological, or financial advice. All decisions and actions taken as a result of participation in the bundle are the sole responsibility of the participant. The Company is not liable for outcomes related to the use of any component of the bundle.
Technology Requirements: Participants must have access to a reliable internet connection, compatible devices, and necessary software to access the digital components of the bundle. The Company is not responsible for participant-specific technical issues, including connectivity problems or device incompatibility.
Governing Law and Dispute Resolution: These Terms are governed by the laws of the State of Colorado without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with the arbitration to be held in the State of Colorado.
